[963243] Correspondence - To Client - Rundown of divorce hearing; advising when marriage will be terminated.  

Purpose

  1. To advise the client when to expect the divorce order. Reason, in the past, clients have asked for the Divorce Order on the day of termination. However, Commonwealth Courts Portal does not upload the Divorce Order until a few days after.

  2. To advise the client that their divorce is terminated after 1 month even if the Divorce Order is not yet uploaded to the Commonwealth Courts Portal. Reason, in the past, clients have asked whether they were divorced even though the Divorce Order was not released.

Correspondence

Thank you for attending the Divorce Hearing today. 

We are happy to note that the hearing went smoothly. The Registrar was satisfied of the following: 

  1. That Natasha was served with the Application for Divorce (“the Application”);

  2. That you were Married as stated in the Application;

  3. That you were separated for 12 months prior to the filing of the Application;

  4. That the relationship had been broken down irretrievably;

  5. That the Federal Circuit Court had jurisdiction to order your divorce;

  6. That proper arrangements had been made in the circumstances for the care welfare and development of the children.

Accordingly, the Registrar pronounced the order for divorce. We note while the order for divorce has been made, your divorce will officially come into effect one month from today (20 August 2021). On the 20 August 2021, your marriage will be terminated and you are free to remarry if you so choose. 

Next Steps

A few days after the 1-month period has expired, the Federal Circuit Court will upload the official Divorce Order to the Commonwealth Courts Portal and we will forward same to you for your records. We note that while it usually takes a few days after the 1-month has expired to receive the official Divorce Order, your divorce is automatically terminated on 20 August 2021.
